These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") apply to the online sale of cosmetic products by CX Factory SAS (hereinafter referred to as the "Seller") to consumers (hereinafter referred to as the "Clients") through the website RoseJules.com (hereinafter referred to as the "Site").
1. Purpose of the GTC
The GTC exclusively apply to the online sale of CX Factory products on the RoseJules.com website (hereinafter referred to as the "Site"), which is accessible to all.
2. Scope of the GTC
The GTC exclusively govern online sales contracts of CX Factory products (hereinafter referred to as the "Professional Seller") to buyers who are consumers (hereinafter referred to as the "Consumers") and, together with the online order, constitute the contractual documents binding on the parties, excluding all other documents, brochures, catalogs, or product photographs which are only indicative.
The GTC exclusively apply to products delivered to consumers located in France and/or in a member country of the European Union.
The GTC and all contractual information mentioned on the Site are written in French.
3. Availability and Enforceability of the GTC
The GTC are directly made available to consumers on the Seller’s Site. The GTC are binding on the Consumer who acknowledges, by ticking a box provided for this purpose, that they have read and accepted them before placing an order.
The confirmation of the order constitutes the Buyer's adherence to the GTC in force on the day of the order, the preservation and reproduction of which are ensured by the Professional Seller in accordance with Article 1127-2 of the Civil Code (formerly C. civ., art. 1369-4).
4. Modification of the GTC
These GTC were updated on March 5, 2024.
The Professional Seller reserves the right to modify its GTC at any time.
In the event of a modification of the GTC, the applicable GTC are those in force on the date of the order, a dated copy of which can be provided to the Consumer upon request.
5. Clauses of the GTC
The nullity of a contractual clause does not entail the nullity of the GTC. The temporary or permanent non-application of one or more clauses of the GTC by the Professional Seller shall not be construed as a waiver of the other clauses of the GTC, which shall continue to have effect.
1. Characteristics
The products offered for sale presented in the catalog published on the Site each have a description mentioning their essential characteristics within the meaning of Article L. 111-1 of the Consumer Code.
The photographs illustrating the products do not constitute a contractual document.
2. Use of the Products
The Site offers products for sale that allow for personal care. These products are intended for individual use only.
Some products offered on the Site may be highly concentrated and potent, potentially dangerous if misused, such as essential oils. CX Factory provides consumers with the necessary information for proper product use.
The information provided about essential oils does not constitute medical information. Any therapeutic use of essential oils should be done under the supervision of a qualified healthcare professional.
CX Factory cannot be held responsible for any damage caused by improper use of the products sold on its Site or by failure to follow usage precautions.
Additionally, CX Factory offers its customers DIY care recipes using ingredients available on the Site. CX Factory reminds customers that the marketing of cosmetic products is regulated by the provisions of the Cosmetic Regulation and the Public Health Code and that any customer wishing to create recipes for commercial purposes must comply with these regulations.
3. Compliance
The products comply with current regulations related to the safety and health of individuals, fair commercial transactions, and consumer protection at the time they are placed on the market. The products comply with the requirements of French law in force at the time they are placed on the market.
4. Stock Availability
The products are offered and delivered within the limits of available stocks.
In case of unavailability of the ordered product, the Seller will immediately inform the Buyer and may offer a product of equivalent quality and price or, failing that, a purchase voucher for the amount of the order usable for any future order.
In case of disagreement from the Buyer, the Seller will refund the amounts paid within 5 business days.
Apart from the refund of the price of the unavailable product, the Seller is not liable for any cancellation indemnity, unless the non-fulfillment of the contract is personally attributable to them.
5. Resale of Products
The products sold on the Site cannot be resold without the written consent of CX Factory.
The products sold on the Site cannot be repackaged and resold without the written consent of CX Factory.
1. Sales Prices
In accordance with Article L. 112-1 of the Consumer Code, sales prices are indicated for each product listed in the electronic catalog, in euros including all taxes, excluding delivery and transportation costs mentioned before order validation and billed additionally.
- If goods are delivered within France: prices include all taxes (French VAT of 20% included).
- If your delivery address is in another EU country different from the shipping country: prices include all taxes with the application of the VAT of the destination country, in accordance with Articles 33 and 59 quater of Directive 2006/112/EC, effective from July 1, 2021.
- If your delivery address is outside the EU (excluding the UK): prices are tax-free under Article 146 of Directive 2006/112/EC. Rose & Jules acts as an exporter from the EU (FCA). When ordering products from rosejules.com for delivery outside the EU (except the UK), as a customer, you may be subject to import duties and taxes. Any additional customs clearance costs will be at your expense; Rose & Jules has no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for more information. Also, please note that when you place an order on Rose & Jules, you are considered the official importer and must comply with all laws and regulations of the country in which you receive the products. We draw the attention of our international customers to the fact that cross-border deliveries are subject to opening and inspection by customs authorities.
The total amount due by the consumer is indicated on the order confirmation page.
The sales price of the product is the price in effect on the day of the order.
The sales price of the products does not include shipping costs, which are billed in addition to the product price.
In the event of a price promotion, the Professional Seller agrees to apply the promotional price to all orders placed during the promotional period.
2. Modification
The Professional Seller reserves the right to modify its prices at any time, while ensuring the application of the price in effect on the day of the order to the consumer.
3. Fees
Additional transport, delivery, or postage costs (including other potential costs borne by the seller), which the client may have been aware of before the order, are specified on the order form.

The online sales offers presented on the Site are reserved for consumers residing in France and/or in a member country of the European Union and for deliveries within these same areas.
2. Duration
The online sales offers presented on the Site are valid, unless a specific duration is indicated, as long as the products are listed in the electronic catalog and within the limits of available stocks.
3. Acceptance
The acceptance of the offer by the consumer is validated, in accordance with the double-click process, by the confirmation of the order.
1. Steps to Conclude the Contract
To place an order, the consumer, after filling their virtual cart by indicating the selected products and the desired quantities, clicks on the "Order" button and provides information related to delivery and payment methods.
Before clicking on the "Confirm Order" button, the consumer has the opportunity to check the details of their order and the total price and to return to the previous pages to correct any errors or possibly modify their order.
The confirmation of the order constitutes acceptance of the GTC and forms the contract.
An email acknowledging receipt of the order and its payment is sent by the Seller as soon as possible.
2. Order Modification
Any modification of the order by the consumer after confirmation of their order is subject to the acceptance of the Professional Seller.
The Professional Seller reserves the right to make changes to the ordered product related to technical developments under the conditions provided for in Article R. 212-4 of the Consumer Code.
3. Order Validation
The Professional Seller reserves the right to refuse any order for legitimate reasons, particularly if the quantities of products ordered are abnormally high for buyers considered consumers. The Seller may also refuse or delay the processing of an order if it suspects any fraud, such as identity theft or payment method theft.

The sales contract is formed at the moment the consumer sends the confirmation of their order.
2. Archiving and Proof
The archiving of communications, order forms, and invoices is carried out on a reliable and durable medium to constitute a true and lasting copy in accordance with Article 1360 of the Civil Code (formerly C. civ., art. 1348). These communications, order forms, and invoices can be produced as proof of the contract.

The full price is payable immediately after the order is confirmed. Payment is made immediately upon ordering by credit card.
2. Payment Security
The Site is equipped with an online payment security system that allows the consumer to encrypt the transmission of their banking data via the secure payment platform's server. At no time will the consumer's banking data transit through CX Factory's computer system.

Delivery refers to the transfer of physical possession of the goods to the consumer.
2. Shipping Time
Under normal conditions, the Professional Seller will process the order as quickly as possible from Monday to Friday, excluding public holidays. CX Factory commits to dispatching orders within 24 working hours following order confirmation, subject to available stock.
3. Delivery Time
The prepared order will be handed over to the carrier, chosen by the customer, for delivery within 2 to 3 days in Metropolitan France or Belgium.
Orders destined for French overseas territories or abroad will be shipped by La Poste or its subsidiaries and delivered by their local partner. Delivery times vary depending on the region or country of delivery.
To facilitate the handover of the order by the carrier, the customer agrees to make the necessary efforts to enable delivery: visible name on the mailbox, transmission of the access code, and phone number.
4. Delayed Delivery
In case of a delivery delay of more than 5 working days, the customer should inform CX Factory's customer service, which will take the necessary and appropriate actions.
5. Delivery Location
Products are delivered to the address indicated by the customer on the order form for home deliveries or to a relay point for deliveries operated by Mondial Relay.
6. Product Conformity
If the product does not conform to the order, the consumer must send a complaint to the Professional Seller to obtain the replacement of the product or possibly the cancellation of the sale.
7. Transfer of Ownership
From the delivery date indicated on the order form, ownership of the product is transferred to the buyer, except in cases where full payment of the price has not been received at the time of the order.
The consumer has the right to return any item within fourteen days from the receipt of their order for an exchange or refund, with the exception of return shipping costs, which remain the consumer's responsibility.
The right of withdrawal can be exercised by contacting our customer service directly from our website in the "Contact Us" section. We will promptly send an acknowledgment of receipt of the withdrawal on a durable medium (e.g., by email).
Returns must be made in their original and complete state, allowing them to be resold as new. Any product that is opened or damaged by the consumer will not be accepted.
In the event of a withdrawal, CX Factory will refund all payments received, either by re-crediting the consumer's credit card or PayPal account, or by bank transfer, depending on the payment method used for the order.
CX Factory may defer the refund until the products are received and verified.
CX Factory processes consumer information in accordance with its Privacy Policy.
CX Factory cannot be held responsible for damages resulting from the improper use of its products.
In the event of a dispute, you should first contact the company's customer service by email (hello@rosejules.com) in an attempt to resolve the issue informally.
This contract and the GTC governing it are subject to French law.
